القاهرة في 25 فبراير 2008م:قالت الشبكة العربية لمعلومات حقوق الإنسان اليوم ، إن قرار وزار الداخلية العمانية ، بتغيير وثائق أسماء قبيلتين عمانيتين ، هما قبيلة "آل تويه" وقبيلة "آل خليفين" ونسبتهما إلي قبيلة أخرى ، يعد عمليا إعادة لمجتمع يخطو خطوات وئيدة تجاه المدنية ، إلي عصور التمييز الاجتماعي الضارب في العنصرية البغيضة ويكرس لمبدأ لفظه العالم الحديث وهو التمييز بناء على الأصل والمركز الاجتماعي . والقرار المعيب الذي أصدرته وزارة الداخلية العمانية وحاولت إخفائه في البداية يعود إلى شهر مايو 2006م ، يقضي بإلغاء مسمَّيي قبيلتين هما قبيلتا "آل خليفين" و"آل تويه" واستبدالهما ب "أولاد خليفين" و"أولاد تويِّه" ،أو إستبدال كلمة آل خليفين وآل تويه بكلمة باسم "الحارثي". وقد أثار القرار الذي أصدرته وزارة الداخلية قلقا شديد بين العديد من القبائل العمانية ، حيث يعد إلغاء صفة القبيلة من الأوراق الرسمية لأي مواطن أو نسبته لقبيلة غير قبيلته ، بمثابة التنزيل لدرجة اجتماعية أدني ، مما يفتح باب التمييز الاجتماعي بشكل واسع ضد هؤلاء المواطنين ويهدر مبدأ المساواة مع باقي المواطنين في الدولة ، لاسيما وأن دولة عمان ورغم جدار السرية والعزلة الذي تفرضه على مواطنيها ، إلا ان هذه العزلة لم تفلح في إخفاء بقايا نظام يعتمد على التمييز الاجتماعي الذي يتضح عبر السمات التي تطلق على المواطنين العمانيين مثل "سيد أو شيخٌ أو أصيلٌ أو عَرْبي" للمواطنين أصحاب المكانة أو السادة ، وسمات مثل" تُبع أو عبد أو مولى أو خادم أو بيسر" على المواطنين الأقل و الأدنى اجتماعيا. وقالت الشبكة العربية لمعلومات حقوق الإنسان " إن هذا القرار الذي لم تبرره وزارة الداخلية ، بنزع هوية مواطنين عمانيين مدونة في وثائقهم الرسمية قبل نشأة دولة عمان نفسها ويبلغ عددهم نحو 450 مواطن لهو أمر غير قانوني على الإطلاق ، ليس من حق شخص أو جهة أن تحرم مواطن من اسمه ، إنه أمر مريب ويثير الشك في دوافعه". جدير بالذكر أن هذا القرار الذي أصدرته "لجنة تصحيح مسميات القبائل والألقاب والأسماء" التابعة لوزارة الداخلية في شكل توصيه ، قد بدأ العمل به منذ أشهر طويلة ، وفضلا عن أنه لم يذكر الأسباب ، و قد صدر في مواجهة قبيلتي "آل تويه وآل خليفين" وحدهما ، وهما من القبائل التي يحمل العديد من المنتسبين لهما وثائق رسمية تعود للستينات من القرن الماضي مثل جوازات سفر وبطاقات شخصية وشهادات ميلاد وغيرها ، أي قبل نشأة دولة عمان نفسها في مطلع السبعينيات من القرن الماضي. وتتعلل وزارة الداخلية بنسبة هذه التوصية "القرار" للقصر الملكي التابع للسلطان قابوس سلطان عمان ، حتى تحصنه من الطعن القضائي عليه بالمحاكم ، إلا أن العديد من أبناء القبيلتين يؤكدون أن السلطان قابوس لا يقبل بهذه التوصية التي ترسخ التمييز الاجتماعي بين المواطنين العمانيين وتهدر المادة 17 من الدستور العماني التي تنص على " المواطنون جميعهم سواسية أمام القانون، وهم متساوون في الحقوق والواجبات العامة، ولا تمييز بينهم في ذلك بسبب الجنس أو الأصل أو اللون أو اللغة أو الدين أو المذهب أو الموطن أو المركز الاجتماعي". وطالبت الشبكة العربية لمعلومات حقوق الإنسان وزارة الداخلية بإلغاء هذا القرار المجحف فورا ، والعمل على ترسيخ مبدأ المساواة بين المواطنين إعمالا لمقومات المجتمعات المدنية الحديثة المستندة للقانون والمواثيق الدولية التي أقرتها سلطنة عمان. معلومات أساسية: إحدى دول مجلس التعاون الخليجي" قطر ، السعودية ، البحرين ، الإمارات ، الكويت ، عمان" تولي السلطان قابوس الحكم في 23يوليو 1970 . يعد الانتماء القبلي هو المعيار الأول للانتماء في عمان ، وتضم سلطنة عمان نحو 230 قبيلة ، ضمنها قبيلة "آل تويه" وقبيلة "آل خليفين" عدد السكان يزيد قليلا عن 3،2 مليون نسمة. ينتمي السلطان قابوس نفسه لإحدى القبائل العمانية وهي قبيلة "آل سعيد". لم تعلن لجنة تصحيح مسميات القبائل والألقاب والأسماء" التابعة لوزارة الداخلية تبريرا صادقا لإلغاء مسمى القبيلتين ، والنزول بهما درجة اجتماعية أدنى ، رغم وجود العديد من الوثائق الرسمية التي تؤكد على انتماء هاتان القبيلتان لعمان قبل عشرات السنين ، كما لا يترتب على احتفاظ أبناء القبيلتين أي ضرر قانوني أو اجتماعي على الإطلاق. كلمة " آل" التي تصر وزارة الداخلية على إلغائها من وثائق المنتمين للقبيلتين ، تعني "أهل" نسبة لأجداد هؤلاء المواطنين. سوف يترتب على إلغاء مسمى القبيلتين أن يعتبرهم الكثير من مواطني عمان مواطنين أدنى درجة ، وهو وضع يحمل في طياته الكثير من التمييز ، لا يوجد سوى في الهند ، حيث طبقة المنبوذين الأدنى اجتماعيا ، طبقا للديانة الهندوسية. رغم قبول بعض أبناء القبيلتين بتغيير أسمائهم حتى يتمكنوا من السفر بالوثائق الجديدة أو استخراج شهادات ميلاد ، في حين يصر العديد على المطالبة بحقهم في الاحتفاظ باسمهم الذي ولدوا به ويحملون الوثائق التي تثبت ذلك. http://www.hrinfo.net/press/2008/pr0225.shtml
Oman: clandestine severe discrimination The ministry of interior undermines the equality principle and abandons the identities of two clans Cairo, February 25, 2008 The Omani ministry of interior has issued a decree to change the official documents of two Omani clans, “Al Tuwaih” and “Al Khulaifain” and to attribute them to a different clan. In its comment today, the Arabic Network for Human Rights Information said that the decree issued by the Omani interior ministry is a set back to the era of the ugly social discrimination and, in the same time, is reviving the principle of ethnic and social discrimination that was eradicated by the modern world. According to the clandestine and faulty decree issued, in May 2006 by the Omani ministry of interior, the names of the tow clans “Al Tuwaih” and “Al Khulaifain” were to be changed to “Awlad Khulaifain” and “Awlad Tuwaih” or to be changed to become “Al Harthi”. The Omani clans expressed their deep concerns about the decree issued by the Omani ministry of interior, since changing any citizen's clan name in the official documents or attributing them to a different clan is a kind of social degradation. Such a decree widely paves the way to social discrimination against those citizens and undermines the principle of equality. Despite the high walls separating the ruling power from the citizens, these walls could not hide the social discrimination adopted by the ruling power. The manifestations of such discrimination are obvious in the titles given to the Omani persons. The highly-positioned persons are given titles like “Master, Sheikh, Highborn, or Arabian” while the socially-humbled citizens are given titles like “servant, slave, serf, or thrall… etc”. “This decree unjustified by the interior ministry to take away the identities of 450 Omani citizens whose identities were officially documented before establishing the modern state of Oman, is illegal”, said the Arabic Network for Human Rights Information. “No one or authority has the right to deprive any citizen from their name. The decree might have clandestine motives”, added the Arabic Network. The decree issued, as a recommendation, by “the committee of correcting clans names, surnames and names” affiliated to the ministry of interior, was put in action months ago. The decree, with no explanation, was activated against the two clans of “Al Tuwaih” and “Al Khulaifain” whose members have official documents, such as passports, IDs, birth certificates, and many other documents dated 1960s i.e. before establishing the modern state of Oman in early 1970s. To immune the decree against judicial contest, the ministry of interior stated that the recommendation “the decree” was issued by the Royal Palace affiliated to Sultan Qabus. Many of the two clans members assured that His Majesty Sultan Qabus never accepts such a recommendation which roots the social discrimination among Omani people and in the same time undermines the article 17 of the Omani constitution which states: “ All citizens are equal before the Law and share the same public rights and duties. There is no discrimination between them on the ground of gender, origin, color, language, religion, sect, domicile, or social status. ” The Arabic Network for Human Rights Information addressed the Omani ministry of interior demanding an immediate abandoning of that unjust decree. The Network also requested the ministry to work on rooting the principle of equality among citizens, and activate the modern civilized communities' constituents based on international laws and covenants signed on by the Sultanate of Oman. Basic information : Oman is a member in the Gulf Cooperation Council which includes ( Qatar , Saudi Arabia , Bahrain , Emirates, Kuwait , and Oman ). Sultan Qabus came to power on July, 23, 1970 . In Oman , belonging to a clan is the primary form of belonging. The sultanate has 230 clans including “Al Tuwaih” and “Al Khulaifain” clans. The population is about 3.2 million people. Sultan Qabus himself belongs to one of the Omani clans which is “Al Saied” “The committee of correcting clans names, surnames and names” affiliated to the ministry of interior did not give any explanation for taking away the two clans names and socially degrading them in spite of the official documents which approve that the two clans belong to Oman, for dozens of years. Also, keeping the clans names has no legal or social harms. The Arabic word “Al”, that the ministry of interior insist on taking away, means “the off springs of” Abandoning the names of these two clans will make their members second-class citizens. Such discrimination is exclusive to Hinduism religion which saves a social low rank for the religiously-renounced persons.
