He and fellow detainee journalists Yazid Khedr, Moaz Asaluady, Mohammed Besharat, Mustafa Sabri should be immediately released from Security Services prisons in the West Bank. A group of Arab human rights organizations issued a public statement today asserting that the Palestinian Military Court ruling against Palestinian journalist Tareq Abu Zeid is "illegal and unjust". The ruling is regarded as a legal precedent and is a violation of the standards for the protection of freedom of speech and expression. The relationship between the Palestinian Authority and Hamas has significantly deteriorated since June 2007. On 16 February 2010, the Palestinian Military Court issued a one and half year prison sentence against Tareq Abu Zeid, a reporter for "Al-Aqsa" (a Hamas-affiliated television network). The Military Court ruling came as a shock to Abu Zeid's family as well as the Jerusalem Center for Legal Aid and Human Rights, which has been acting in Abu Zeid's defense since his arrest by Palestinian Military Intelligence on 8 November 2009. According to a joint-report by the Centre for the Defense of Media Freedoms "Skies" and Jerusalem Center lawyer Bassam Karajh, "The defense of detainee Abu Zeid resulted in The Palestinian High Court's decision to release him, and to cancel the Chief of Military Justice's order for his arrest." He added: "Unfortunately, we waited for the intelligence agency's implementation of the resolution but that did not happen, so the Center sent a copy of the Abu Zeid's release order to The Council of Ministers, in order for them to direct the Intelligence Services to release him." Karajh confirmed, "The non-implementation of the court's ruling by the military court was contrary to Article (106) of the Palestinian Basic Law, which stipulates that judicial decisions are enforceable and that non-implementation is considered a violation of the law and is punishable by imprisonment and removal from office, if the omission was by a public servant." According to sources at Nablus City Military Prosecution, Tareq Abu Zeid was sentenced to a year and a half on charges of seditious acts, imparting information and smuggling money to parties hostile to the Palestinian National Authority in a manner contrary to the provisions of Palestinian law. The institutions and organizations signing this statement, alongside lawyers and Palestinian legal experts, stress that the Palestinian Military Court does not have the authority to use its jurisdiction over civilians and is therefore undermining the powers of civil courts. Civilians should under no circumstance be presented before the Court as this contradicts the Palestinian Basic Law, as well as the Palestinian Constitution. The Military Justice Panel, through the military tribunals, applies the Revolutionary Penal Code and the Code of Criminal Procedure; both of these are considered law by the Palestinian Liberation Organization since 1978, which has adjudicated them and held field court-martials based on them while in Lebanon. The government of Dr. Salam Fayyad banned Hamas-affiliated "Al-Aqsa" from working in the West Bank on 16 September 2007. The ruling against Abu Zeid sparked a large wave of anger in the media, which consider his trial as not only a political crime, but an attack on press freedom and a new setback to freedom of speech and expression in the Palestinian Territories. Abu Zeid, who comes from Jenin in the northern West Bank, was arrested by Israeli forces and spent about 11 months in the Negev desert prison before being released on 16 December 2008. He was later arrested on 27 August 2009, by the Palestinian intelligence service, where he remained for 22 days. His most recent arrest by the Palestinian intelligence services took place on 8 November 2009, however, at the time, he was already held at Al-Junayd prison in Nablus. He was subsequently detained at the disposal of the military judiciary. The human rights organizations which are signatories to this statement strongly denounce and condemn the fact that these reporters are presented before military courts in an attempt to silence them. We further call upon the Palestinian Authority leadership to immediately intervene, requesting that the judicial authorities reverse the unjust sentence against Abu Zaid and immediately release him and the following detainee journalists from the Security Services prison in the West Bank: Yazid Khedr, Moaz Asaluady, Mohammed Besharat, Mustafa Sabri Respect for the inviolability of freedom of speech and freedom of expression has become a matter of seminal importance throughout the Palestinian Territories. فلسطين: حرية الرأي والتعبير في فلسطين تحت بؤرة الضوء 22 فبراير 2010 ينبغي وقف قرار الحكم الجائر على الصحافي طارق أبو زيد، والإفراج الفوري عنه وعن الصحافيين المعتقلين وهم: يزيد خضر، معاذ السلوداي، محمد بشارات ومصطفى صبري من سجون الأجهزة الأمنية في الضفة الغربية. قالت مجموعة من منظمات حقوق الإنسان العربية في بيان علني صدر اليوم أن الحكم الذي صدر على الصحافي الفلسطيني طارق أبو زيد من قبل محكمة عسكرية خاصة هو غير شرعي وجائر من الناحية القانونية ويعد سابقة من نوعها ومخالف لمعايير حماية حرية الرأي والتعبير، منذ تأسيس السلطة الوطنية الفلسطينية حتى بعد أن تدهورت العلاقة بين السلطة الفلسطينية وحركة حماس في حزيران 2007. وكانت المحكمة العسكرية الفلسطينية قد أصدرت في 16 شباط/فبراير، قرارا بالسجن عام ونصف على مراسل فضائية "الأقصى" التابعة لحركة حماس طارق أبو زيد الذي لم يرتكب جرماً غير أنه مراسل تلفزيوني. وقد جاء حكم المحكمة العسكرية سريعا ومفاجئا لعائلة أبو زيد ولمركز القدس للمساعدة القانونية وحقوق الإنسان الذي تولى الدفاع عن الصحافي أبو زيد منذ اعتقاله في الثامن من تشرين ثاني 2009 على يد جهاز االإستخبارات العسكرية الفلسطيني. وبحسب تقرير لمركز الدفاع عن الحريات الإعلامية "سكايز" وتصريح لمحامي مركز القدس بسام كراجة ف "إن الدفاع عن الموقوف أبو زيد تمخض عن قرار محكمة العدل العليا الفلسطيني بإخلاء سبيله، وإلغاء الأمر الصادر عن رئيس هيئة القضاء العسكري باعتقاله". وأضاف: "للأسف، إنتظرنا أن يقوم جهاز الاستخبارات بتنفيذ القرار لكن ذلك لم يحدث، فقام المركز بإرسال صورة عن قرار الإفراج إلى مجلس الوزراء للإيعاز لجهاز الاستخبارات بالإفراج عن الصحفي أبو زيد". وأكد كراجة إن "عدم تنفيذ الحكم من قبل هيئة القضاء العسكري يعتبر مخالفا لنص المادة (106) من القانون الأساسي الفلسطيني التي نصت على أن الأحكام القضائية واجبة النفاذ والامتناع عن تنفيذها يشكل مخالفة للقانون وتكون عقوبتها الحبس والعزل من الوظيفة إذا كان الممتنع موظف عام". وبحسب مصادر في النيابة العسكرية في مدينة نابلس فقد تم الحكم على طارق أبو زيد بالسجن لمدة عام ونصف بتهم القيام بأعمال تحريضية ونقل معلومات وتهريب وأموال لجهات معادية للسلطة الوطنية الفلسطينية بطريقة مخالفة لأحكام القانون الفلسطيني. وتؤكد المؤسسات والمنظمات الموقعة على هذا البيان مع حقوقيون وخبراء قانون فلسطينيون إن هيئة القضاء العسكري الفلسطيني لا تعتبر صاحبة ولاية على المدنيين، وما تقوم به هو اغتصاب لصلاحيات القضاء المدني، إذا لا يجوز أن يمثل أمامها مدنيين بأي حال من الأحوال، لأن ذلك يناقض القانون الأساسي الفلسطيني الذي يعتبر بمثابة الدستور الفلسطيني". وتقوم هيئة القضاء العسكري من خلال المحاكم العسكرية بتطبيق قانوني العقوبات الثوري وأصول المحاكمات الجزائية وكلاهما يعتبران قوانين منظمة التحرير الفلسطينية لعام 1978 التي كانت تحكم بهما وتعقد على أساسهما المحاكم العسكرية الميدانية أثناء وجودها في لبنان. يذكر أن حكومة الدكتور سلام فياض قد حظرت عمل تلفزيون الأقصى التابع لحركة حماس من العمل في الضفة الغربية بتاريخ 16/9/2007. وأثار الحكم على الصحافي أبو زيد موجة غضب كبيرة في الأوساط الإعلامية التي اعتبرت محاكمته جريمة سياسية وطعنه في خاصرة حرية الصحافة وانتكاسة جديدة لحرية الرأي والتعبير في الأراضي الفلسطينية. وكان الصحافي أبو زيد، وهو من مدينة جنين، قد أعتقل من قبل القوات الإسرائيلية وأمضى في سجن النقب الصحراوي نحو 11 شهرا، قبل أن يتم إطلاق سراحه في 16 كانون الأول/ديسمبر 2008. وتم اعتقاله لاحقا بتاريخ 27 آب 2009، من قبل جهاز المخابرات الفلسطيني حيث أمضى هناك (22 يوما) . والاعتقال الأخير من قبل جهاز الاستخبارات الفلسطيني جرى في 8 تشرين الثاني 2009، حيث ما يزال في سجن الجنيد في مدينة نابلس معتقلا على ذمة هيئة القضاء العسكري. إن منظمات حقوق الإنسان الموقعة على هذا البيان إذ تدين وتستنكر بشدة التعرض للصحافيين ومثولهم أمام محاكم عسكرية في محاولة لكم الأفواه وتكبيل الأقلام، وتطالب قيادة السلطة الفلسطينية بالتدخل الفوري والسلطات القضائية المختصة بالتراجع عن قرار الحكم الجائر على أبو زيد، والإفراج الفوري عنه وعن الصحافيين المعتقلين وهم : يزيد خضر، معاذ السلوداي، محمد بشارات ومصطفى صبري من سجون الأجهزة الأمنية في الضفة الغربية، واحترام حرية الرأي والتعبير وعدم المساس بها كونها أصبحت محط الأنظار في الأراضي الفلسطينية كافة. المنظمات والمؤسسات الموقعة : الشبكة العربية لمعلومات حقوق الإنسان / مصر المرکز العربي الأوربي لحقوق الانسان والقانون الدولي/ النرويج الجمعية اللبنانية لحقوق الإنسان جريدة الفجر نيوز المنظمة الوطنية لحقوق الانسان في سورية لجنة الدفاع عن الصحفيين في سورية الرابطة السورية للدفاع عن حقوق الانسان التحالف السوري لمناهضة عقوبة الإعدام المركز السوري لمساعدة السجناء الجمعية الفلسطينية لحقوق الإنسان (راصد) لبنان -
