القاهرة في 29 يوليو 2008 - الفجرنيوز:في 12 يوليو قام احد القضاة الإتحاديين بالولاياتالمتحدة بمنح سامي العريان إفراج بكفالة بعد أن قرر أنه لا يعد خطراً على المجتمع ولا خوف من هربه. على الرغم من هذا الحكم ما زال سامي محتجزاً في سجن امريكي بواسطة دائرة إنفاذ قوانين الهجرة والجمارك الأمريكية وتحت أسوأ ظروف منذ بداية فترة سجنه في 2003. وتفرض دائرة إنفاذ قوانين الهجرة والجمارك قرارها على العريان المقيم الدائم بالولاياتالمتحدة، والذي يعود إلى أمر الترحيل الصادر في أبريل 2004، والذي كان بنداً في اتفاقية إقرار بالذنب عقدها العريان مع حكومة الولاياتالمتحدة. وقد قامت السلطات الأمريكية مراراً وتكراراً بالإخلال بهذه الإتفاقية بسبب استمرارها في استدعاء العريان، وإبقاءه مسجوناً بالرغم من الموافقة على ترحيله. ويرى محامي العريان أن الاستدعاء الأخير للمثول أمام هيئة محلفين عليا محاولةً من الحكومة "لإعادة محاكمة فلوريدا، والتي كانت خسارة كبيرة لوزارة العدل الامريكية وختمت باتفاقية الإقرار بالذنب سنة 2006." تم نقل العريان إلى سجن يبعد حوالي 100 ميل من واشنطن دي سي، حيث يعيش اكبر ولدين له، وبالقرب من المكان الذي ستجرى فيه محاكمته القادمة. وعلى أي حال فحتى مع احتجاز العريان في مكان قريب من ولديه، فإنهما قد حرما من حقهما في زيارة والدهما. كما أن المسافة جعلت من الصعب جداً لقاء العريان بمحاميه للتحضير للمحاكمة القادمة. ويعاني العريان من السجن التام لمدة 23 ساعة في اليوم، في مكان منعزل تماماً، بالرغم من وعود إدارة إنفاذ قوانين الهجرة بإبقائه مع السجناء الآخرين. كما أن هنالك تقارير عن إساءة المعاملة من قبل حراس السجن الذي حولوه إلى سجن جديد، حيث أبقوه مقيد اليدين والقدمين طوال الرحلة إلى السجن الجديد بالرغم من إصابة معصمه، وثمة مخاوف من تعرضه لإساءة مماثلة داخل السجن الجديد. وقد كان متوقعاً أن يستمتع العريان بلحظة من الحرية بعد خمس سنوات من السجن ولكن الامر ليس كذلك مع حكومة الولاياتالمتحدة التي تستهدف الناشط الفلسطيني الامريكي بلا هوادة.
More Than Two Weeks After Being Granted Bond Sami Al-Arian Is Still Being Held and Subjected to Abusive Prison Conditions Cairo 29th July, 2008 On July 12th a US Federal Judge granted Sami Al-Arian bail after deciding that he was not a danger to the community or a flight risk. Despite this ruling Al-Arian is still being held in a US prison by United States Immigration Customs and Enforcement Department (ICE) and under some of the worse conditions since he was first imprisoned in 2003. ICE invoked their jurisdiction over US permanent resident Al-Arian relating back to the April 2008 deportation order, which was part of Al-Arian's plea agreement with the government. US authorities have consistently broken that agreement because they have continued to subpoena Al-Arian and have kept him imprisoned despite agreeing to deport him. Al-Arian's attorney sees the most recent grand jury subpoena as an attempt by the government to “to revisit the Florida trial, which was a major loss from the US Justice Department and closed by the 2006 plea agreement.” Al-Arian was transported to a prison 100 miles away from the Washington DC area where his two oldest children live and near where his next trial will take place. However, even when Al-Arian was being held close to his children they were denied the right to visit their father. The distance is also making it extremely difficult for Al-Arian to meet with his lawyers to prepare for his upcoming trial. Al-Arian is under a 23-hour lock down and has been placed in isolation, despite promises from the ICE to keep him with the general inmate population. There are reports of abuse by the guards who transferred him to the new prison, as they kept him shackled and handcuffed for the entire ride to the new prison despite his wrist injury and there is a worry that he will be subject to similar abuse inside the prison. It was expected that Sami Al-Arian would be enjoying a moment of freedom after five years of imprisonment but that is not the case because of the US governments relentless targeting of the Palestinian American activist.
