الأربعاء 5 مارس 2008م:أكدت المنظمات والمؤسسات الحقوقية الموقعة أدناه أنها ترفض تماما وثيقة تنظيم البث والاستقبال الإذاعي والفضائي ، التي أعلنها وزراء الإعلام العرب في 12 فبراير 2008. وقالت المنظمات أن الميثاق المقترح والذي يحوي 12 بندا 34 منظمة حقوقية عربية ودولية تعلن : وثيقة تنظيم البث الفضائي باطلة من حيث الشكل والمضمون الأربعاء 5 مارس 2008م: أكدت المنظمات والمؤسسات الحقوقية الموقعة أدناه أنها ترفض تماما وثيقة تنظيم البث والاستقبال الإذاعي والفضائي ، التي أعلنها وزراء الإعلام العرب في 12 فبراير 2008. وقالت المنظمات أن الميثاق المقترح والذي يحوي 12 بندا ، يذخر بنصوص مبهمة ، تفرض – في واقع الأمر - قيودا جديدة على حرية التعبير في الفضائيات العربية ، ولا قيمه قانونية لها دون موافقة البرلمانات العربية عليها. وعلى الرغم من أن الوثيقة تدعي في بندها الأول بأنها تهدف إلى " تنظيم البث وإعادته واستقباله في المنطقة العربية، وكفالة احترام الحق في التعبير عن الرأي، وانتشار الثقافة وتفعيل الحوار الثقافي من خلال البث الفضائي"، فإن عددا من بنودها حفل بنصوص تتطابق مع ذات التهم التي تواجه بها الحكومات العربية منتقديها من نوعية: " التأثير سلبا على السلم الاجتماعي والوحدة الوطنية والنظام العام والآداب العامة"، و"حماية المصالح العليا للدول العربية"، و"احترام مبدأ السيادة الوطنية لكل دولة على أرضها". وقالت المؤسسات والمنظمات الحقوقية والمدافعة عن حرية التعبير "أن بنود الوثيقة تهدف بالأساس إلى إحكام السيطرة على البرامج الحوارية والوثائقية التي تسلط الضوء على الممارسات القمعية وقضايا الفساد المستشري في العالم العربي لحكومات جاء أغلبها للحكم عبر طرق بعيدة عن الديمقراطية ولا تعبر عن إرادة شعوبها". وقد فرضت هذه الوثيقة تعبيرات مطاطة تخضع للتأويل الحكومي مثل نقد الحكام والقادة الدينيين فيما أشارت إليه ب "عدم تناول القادة أو الرموز الوطنية والدينية بالتجريح" وبالطبع لا تحدد الوثيقة الحدود الفاصلة بين النقد والتجريح، بما يصادر حق النقد المباح، كما لم تفصح بوضوح ما هي معايير تحديد هؤلاء الرموز ، وهو ما يهدد بملاحقة الإعلاميين الجادين ويحرمهم من ممارسة دورهم الرقابي الذي تكفله الدساتير والمواثيق الدولية. وقد ألزمت الوثيقة هيئات البث الإذاعي والتلفزيوني بإخضاع محتويات البرامج للجنة مختصة بالرقابة بدعوى فرض جداول زمنية للبرامج، وحماية الأطفال من المواد الإعلامية غير المناسبة، وهو ما يسمح – بالطبع – بتدخل الرقابة في محتوى ما يتم بثه من برامج ، لا ترضى عنها هذه الحكومات. وتؤكد المنظمات الحقوقية الموقعة أنه فضلا عن التجاوزات التي حفلت بها الوثيقة ضد حرية البث والنشر كجزء من حرية التعبير ، فقد تجاوزت أيضا الطريق الشرعي لإقرار أي وثيقة أو اتفاقية وجعلها ملزمة ، حيث لابد من موافقة البرلمانات والمجالس التشريعية عليها ، وفقا لما تنص عليه الدساتير في التعامل مع أي اتفاقية دولية. أما التعلل بأنها مجرد "وثيقة مبادئ" فهذا يعني عدم جواز اتخاذ أي إجراءات ضد أي قناة أو محطة فضائية تمارس حقها في بث المعلومات والأخبار بالشكل الذي يتوافق مع سياستها. وهو عكس ما تضمنته الوثيقة من فرض عقوبات تصل لحد مصادرة الأجهزة والمعدات، ووقف التراخيص للقنوات والمحطات –المخالفة من وجهة نظر الحكومات- ضربا لقاعدة "لا عقوبة إلا بنص قانوني". لذلك تعلن المؤسسات والمنظمات الموقعة على هذا البيان أنها لن تتأخر في دعم حركة الرفض الواسعة ضد هذه الوثيقة والتأكيد على حق المؤسسات الإعلامية في ممارسه عملها بدون قيود أو رقابة ، والانحياز لحق المواطنين في برامج جادة تكشف العيوب وتفضح الانتهاكات اليومية التي يعاني منها المواطنين العرب . المنظمات الموقعة (حسب الترتيب الأبجدي): الشبكة العربية لمعلومات حقوق الإنسان البرنامج العربي لنشطاء حقوق الإنسان "مصر" الجمعية الفلسطينية لحقوق الإنسان (راصد( لبنان الجمعية المصرية لدعم التطور الديمقراطي"مصر" الجمعية المصرية للنهوض بالمشاركة المجتمعية "مصر" الجمعية المصرية للحقوق الاقتصادية و الاجتماعية"مصر" الحزب المصري الاجتماعي الديمقراطي " مصر " اللجنة التنسيقية للحقوق والحريات النقابية والعمالية"مصر" اللجنة السورية لحقوق الإنسان " سوريا " المرصد المصري للعدالة و القانون "مصر" المركز المصري لحقوق السكن المركز الوطني للقانون وحقوق الإنسان"مصر" المعهد الديمقراطي المصري " مصر " المؤسسة العربية لدعم المجتمع المدني وحقوق الإنسان " مصر " الهيئة الوطنية للدفاع عن الحقوق والحريات " اليمن " جماعة تنمية الديمقراطية "مصر" جمعية البحرين لحقوق الإنسان "البحرين " جمعية العون المصرية لحقوق الانسان " مصر " جمعية حقوق الإنسان أولا " السعودية" جمعية شباب البحرين لحقوق الإنسان " البحرين " جمعية مراقبة العدل فى الصومال . مجموعة المساعدة القانونية لحقوق الإنسان"مصر" مركز الأرض لحقوق الإنسان "مصر" مركز البحرين لحقوق الإنسان " البحرين " مركز الحرية للحقوق السياسية ودعم الديمقراطية " مصر " مركز القاهرة لدراسات حقوق الإنسان"مصر" مركز النديم للعلاج والتأهيل النفسي لضحايا العنف "مصر" مركز أندلس لدراسات التسامح ومناهضة العنف"مصر" مركز دمشق للدراسات النظرية والحقوق المدنية "سوريا " مركز حابي للحقوق البيئية "مصر" مركز ماعت للدراسات الحقوقية و الدستورية "مصر" مركز هشام مبارك للقانون "مصر" ملتقي الحوار للتنمية و حقوق الإنسان "مصر" مؤسسة حرية الفكر و التعبير "مصر" http://www.hrinfo.net/press/2008/pr0305.shtml 34 International and Arabian Human Rights Organizations declare: The document of organizing space transmission is invalid through its form and content Wednesday, March 5, 2008 The undersigned human rights organizations confirmed their total rejection of the document of "organizing space & radio broadcasting" which was declared by Arab ministers of information on February 12, 2008. Human rights organizations said that the suggested document which contains 12 articles, is full of ambiguous statements that impose new restrictions on freedom of expression on the Arab space channels and it is worthless without the affirmation of the Arabian parliaments. Despite the document's first claim that aims to "organize, broadcasting and rebroadcasting, as well as receiving broadcasts in the Arab region, pay respect to freedom of expression, spread culture, and activate the cultural role through the space transmission", we find that some articles are contain statements that correspond to the same charges targeting opponents of the Arab governments who criticize their policies such as "the negative impact upon social peace, national unity, public order & politeness, protecting high interests of the Arab countries and respecting the principle of national sovereignty of each country over its own land". Human rights organizations who advocate freedom of expression stated that "the document articles aim in the first place to restrict documentary and dialogue programs which highlight and expose repressive exercises and corruption cases widespread all over the Arab world via governments that obtained access to the throne through non-democratic ways without their communities consent. This document imposed open changes subject to governmental justification such as criticizing religious and political leaders described in the document as "not discrediting national leaders & religious icons". The document neither defined the borderlines between criticism and discrediting nor clarified clearly the standards to determine those icons. This consequently would result in targeting serious media program makers and opening the door for governments to practice control & repression against freedom of expression which violates the rights stated by international constitutions and charters. The document obliged television and broadcasting transmission corporations to subject their program contents to a committee in charge of censorship, to impose a time table for the programs and protect children from inappropriate media materials. This would allow the censorship authority to interfere into the content of programs transmitted that governments don't like. The undersigned human rights organizations assure that overstepping articles are included in the document against freedom of publication & transmission as part of freedom of expression. Additionally we find that it overstepped the legitimate road to enact any document or agreement in order to make it mandatory, as the parliaments and legislative authorities must consent to them first according to what is stated in the constitution in regards to the deal with any international agreement. The governmental claim that it is just “a document of principles” as a justification, denies the possibility of taking any legal procedures against any space channel which practices their right to broadcast news and information in a way that corresponds to their own strategy . This contradicts with what is included in the document imposing certain punishments which could result in confiscating sets & equipments and license seizure of channels – opposing governments perspectives. This of course violates the legal rule that "no punishment without a legal act". Regarding this issue, the undersigned human rights organizations declare they will take the lead in supporting the wide rejectionist movement against this document, acknowledging the right of media corporations to have their work done with no restrictions or censorship and standing by the citizens right to have serious programs that reveal corruption and unmask daily violations that citizens suffer from on a daily basis.
